Legal notice

This legal notice sets out the general terms and conditions regulating access and use of the portal www.texbor.com, hereinafter ‘the portal’ which is owned by “Texbor, S.A.”, hereinafter the Owner.

Portal use implies express and full acceptance of the present general terms and conditions, of each and every provision included in the present Legal Notice in the published version when users access said Notice. For this reason, users must read the present Legal Notice every time they access the Portal as changes may be made to the general terms and conditions, without prejudice to the specific conditions that may apply to certain specific portal services.

The access to the portal is free and their visualization does not require any previous subscription not even register. Through the portal information of the company TEXBOR, S.A. is facilitated and the visitor is invited to being able to buy in their shops ON-LINE.

Liabilities

The information contained on the portal is that in force on the last update date. The Owner does not guarantee possible errors on accessing the portal, nor its contents; in turn, it will take the appropriate measures to avoid, correct and/or update them as soon as they are detected.

The Owner reserves the right to change and update portal information and configuration and the access terms and conditions without the need for any prior notice and at any time. Equally, the Owner reserves the right to completely or partially change and/or omit the portal contents, as well as restrict access.

If maintenance, repair, updating or service improvement operations must be performed, the Owner reserves the right to temporarily suspend portal access without the need for prior notice, as well as the right to supply or cancel services, without prejudice to trying to make it known to users, as long as circumstances permit it.

Use of this portal and the information provided is the responsibility of users. The Owner is not liable for any damage caused or which may occur of any nature arising from use of the information, material on the portal and the programmes thereon. The Owner is not liable for the use that website users and/or clients make of the services, contents, links and hyperlinks included on the portal.

Any third party may establish a framing link between their websites and the portal. Equally, the Owner accepts no liability for the content of third party content which may be accessed via links on the portal.

Copyright on the contents

All elements on the portal, as well as its structure, design and source code, are the property of "Texbor, S.A." and are protected by copyright regulations. No reproduction, modification, distribution or public notification of the Portal may be made without prior consent from the Owner. User and/or client access to Portal content and services does not imply any right to transfer, cede, right of use, alteration, operation, reproduction, distribution or public notification of the latter subject to copyright, without prior express authorisation specifically awarded for the purpose by the Owner or third party rights owner, where applicable.

Portal users and/or clients may only perform private and personal use of the contents thereof, i.e., they shall only have the right to view and make copies of the contents for their own personal exclusive use, having to exercise these rights on the basis of good faith principles and applicable regulations. Use of the portal or any of its elements for commercial or illegal purposes is strictly forbidden.

Unauthorised use of the information contained on this portal, as well as damages caused to copyright, may lead to necessary legal action being taken and, where applicable, the liabilities arising from said exercise.

Data protection

In strict compliance with Law 15/2003 on personal data protection, users are informed that:

Visiting the portal is anonymous. However, with the aim of offering better service and aiding portal use, the number of pages visited, the number of visits, as well as visitor activity on the portal and their use frequency are analysed.

Users and/or clients are informed that their personal data will form part of the Usuaris file, managed by the Owner, the aim of which is to send information, news, publicity and any other activity that may be performed. In turn, users and/or clients are informed that they may exercise their rights to access, rectify, eliminate and oppose via the website www.texbor.com or address consultas.online@texbor.com. Users and/or clients are obliged to constantly maintain their information updated and truthful. 

Personal data held in the file “Usuaris” will only be transferred to third parties where necessary, with the sole aim of fulfilling the objectives for which the portal is designed.

Obligations

Not carrying out misleading publicity.

The Owner commits to not carrying out any misleading publicity. In this sense, misleading publicity will not be understood as formal or numerical errors which the contents of the different portal sections may contain due to incomplete or faulty maintenance and/or updating of the information in those portal sections as a consequence of what is mentioned in this section, and the Owner commits to correcting them as soon as it is made aware of said errors.

Not sending out commercial notifications without identifying them. 

In accordance with what is set out in Law 15/2003 on personal data protection, the Owner commits to not sending out any publicity or promotional notifications by e-mail nor by any other similar electronic communication method without identifying them as a commercial notification and without them having been requested or expressly authorised beforehand by addressees of the same.

In this sense, commercial notification shall not be considered information sent from the portal whose purpose is to maintain a user or contractual relationship, where applicable, as well as the development of information tasks, training and other activities from the service which users and/or clients have agreed.

Equally, addressees may cancel their consent for storage of their data for promotional purposes directly, simply and freely via the portal.

Cookies

The portal uses cookies which are stored on user and/or client computers. Cookies are small files the server sends to user and/or client computers but do not provide any personal information. The server where the portal is stored automatically recognises client and/or user computer IP addresses, the day and time when the connection begins and terminates, as well as information on the different sections visited. The server requires these data so as to communicate.

Users and/or clients may configure their browser so that it notifies them of the presence of cookies. Equally, users may configure their browser so that it does not receive these cookies since this does not hinder access to portal information.

Be that as it may, portal access implies user and/or client acceptance of the aforementioned cookies and any other which for technical, organisational or any other type of reasons may exist.  

Use policies

Users and/or clients are liable for compliance with current laws and regulations and rules applicable to the use made of products and applications. Nonetheless, any portal use contrary to good faith is forbidden and, specifically, including but not limited to:

Use contrary to Andorran legislation or which contravenes third party rights.

The publication or transmission of any content which is violent, obscene, abusive, illegal, racist, xenophobic or defamatory.

Alteration or intervention via fraudulent methods of personal websites or e-mail or systems belonging to other users or third parties without their authorisation.

Cracks, programme series numbers or any other content violating third party intellectual property rights.

The collection and/or use of other users’ personal data without their express consent or contravening what is set out in Law 15/2003 on personal data protection.Use of the e-mail server, domain and e-mail addresses for the purposes of spamming, mail bombing, stealing identity, third party fraud, Scam 419, pharming, spreading viruses (Trojans, etc.) or any other types of activity performed with fraudulent or criminal intent.

Clients and/or users are obliged to keep the e-mail address they provided on the supplied form operational, active and updated since it is the preferred notification method used by the portal.

Users and/or clients are solely liable for the content of the data and information sent and stored on the contracted or authorised spaces not managed by the portal, as well as hyperlinks, third party demands and legal actions that may affect intellectual property, legal rights, data protection and any other.

It is expressly forbidden to access, change or view the configuration, structure and files on the portal servers. Any problem which may occur with the portal servers and security systems as a direct result of client and/or user negligence will result in the latter being responsible for the corresponding civil or penal liability.

Clients and/or users shall respect the technical standards on the portal in the administration and development of products used and/or contracted so that there is no abusive use slowing the servers prejudicing the provision of products or the rights of other users and/or clients.

Users who take out contracts via the portal recognise they are of legal age. Contracts taken out by minors requires prior authorisation from parents, guardians or legal representative who shall be considered liable for the contract taken out by the minors in their charge.

Copyright

All rights deriving from copyright are expressly reserved by the Owner. The source code, graphic design, images, photographs, music, sounds, animations, software, texts, domain names, brands, as well as the information and contents on the entire website are protected by Andorran legislation in favour of the Owner.

The Owner neither totally nor partially allows reproduction, publication, IT storage, distribution, broadcast, modification, transformation or decompilation without prior written permission. Users may only use the material appearing on the portal for their personal and private use, with use for commercial purposes or any other use neither personal nor private being strictly forbidden.

The Owner shall supervise both fulfilment of the terms and conditions above and proper use of its intellectual and industrial copyright, taking any legal actions necessary.

The Owner may change the information contained on the portal, as well as its configuration and presentation, without prior notice.

Acceptance

Portal access and use implies user and/or client consent and acceptance and their adherence to the aforementioned terms and conditions.
